In any event, RTHMFit's total liability to you for all losses and damages, including implied warranties, will not exceed the greater of fifty U.S. dollars (US $50.00) or the total amount you paid RTHMFit for any service or feature of the RTHMFit Sites in the twelve months prior to the initial claim.
Indemnity
By using the Site, you agree, to the extent permitted by law, to defend, indemnify, and hold harmless RTHMFit, its officers, directors, employees, and agents from and against any claims, actions, or demands, including reasonable legal and accounting fees, arising from your breach of these Terms of Use or your violation of any law or third-party rights.
The RTHMFit Service is not intended to diagnose, treat, cure, or prevent any disease or health condition. If you have a medical or heart condition, consult your doctor before using the RTHMFit Service. In the event of a medical emergency, stop using the RTHMFit Service and seek immediate medical attention. We are not liable for any health problems that may result from products or events you learn about through the RTHMFit Service. Participating in any exercise program you learn about through the RTHMFit Service is at your own risk and voluntary.
Prolonged contact with wearable devices may cause skin irritation or allergies in some users. To minimize irritation, follow these tips: (1) keep the device clean, (2) keep it dry, (3) avoid wearing it too tight, and (4) remove the band for an hour after extended wear. If you experience skin irritation, soreness, tingling, numbness, burning, or stiffness in your hands or wrists while wearing the device, discontinue use and consult your doctor if symptoms persist for more than 2-3 days after removing the device.
RTHMFit products with heart rate tracking features may pose risks to users with certain health conditions. Consult your doctor before using such products if you: (1) have a medical or heart condition, (2) are taking photosensitive medication, (3) have epilepsy or are sensitive to flashing lights, (4) have reduced circulation or bruise easily, or (5) have tendonitis, carpal tunnel syndrome, or other musculoskeletal disorders.
Unless stated otherwise, these Terms represent the complete and exclusive agreement between you and RTHMFit regarding the RTHMFit Service, replacing any prior oral or written agreements between us concerning the RTHMFit Service and Content.
We will notify you of any significant changes to these Terms and provide you with an opportunity to review the revised Terms before continuing to use the RTHMFit Service. By using the RTHMFit Service after modifications take effect, you are agreeing to the updated Terms. Previous versions of these Terms can be reviewed in our archive.
If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, that provision will be enforced to the maximum extent possible, and the remaining provisions will continue in full force and effect.
